About Visitation in Monmouth County

Divorce Attorney Serving Freehold, Colts Neck, & Monmouth County

"As a New Jersey Family Law Attorney, I know that visitation issues ("parenting time") can be emotional and difficult issues in many divorce and other family law cases.

Gone are the days of fathers automatically receiving alternate weekend visitation with their children plus one evening for dinner in virtually every case.

While this still happens in many cases, many other fathers are not content with this traditional approach that many judges, lawyers, and litigants had found to be acceptable in the past. Creative lawyering has resulted in many different types of timesharing arrangements for parents with their children.

Sometimes a parent will inappropriately deny access to a child to the other parent. Click here for a specific recommendation I have made regarding how I feel that the NJ Family Court can improve the need for immediate access to Superior Court Judges in parenting time dispute situations.

Father’s Rights

In the past few years, I have seen a dramatic increase in the number of fathers who seek (and obtain) primary custody. Fathers can argue for their fathers’ rights in many situations and will work hard to make sure that they are given a fair amount of time with their children. If you are a father who is being deprived of the right to share significant, quality time with your child, I can help.

Grandparent Visitation

Additionally, New Jersey has a statute allowing grandparents to seek visitation over the objection of one of the children's biological parents in appropriate circumstances. Grandparents are given the right to go to court over this issue. If the courts find it appropriate to allow the child time with the grandparents, then a parent’s wishes can be denied in order to give the children time with their grandma and grandpa. Are you a grandparent seeking visitation rights with your grandchildren? If so, I would be happy to discuss your rights with you.
